Terms and Conditions of Use

1. Subject and acceptance

These Terms and Conditions govern access to and use of the website https://moscardinostudio.com and of all the content published on it. By browsing the site the user declares that they have read them and accept them in full. Anyone who does not intend to accept them is invited not to use the site.

Use of the site is also subject to the Privacy Notice and the Cookie Policy, which form an integral part of it.

2. Nature of the site and absence of a commercial offer

MOSCARDINO STUDIO is an informal creative collective, made up of a group of natural persons who collaborate voluntarily in the making of audiovisual works. It is not a company: the collective is not registered with the Companies Register, has no legal personality and does not, as such, carry on an organised commercial activity.

This site is exclusively informational and a portfolio: it collects and presents the audiovisual works made by the collective and recounts its path.

The published contents do not constitute an offer to the public pursuant to Art. 1336 of the Italian Civil Code, nor a contractual proposal, nor a binding commitment to supply services or to produce works. No prices, tariffs or economic conditions of any kind are published on the site. Any collaboration is agreed separately and individually between the interested parties, through agreements independent of this site.

3. Ownership and intellectual property

All contents published on the site \u2014 audiovisual works, stills, images, texts, graphics, visual-identity elements, the name \u00abMOSCARDINO\u00bb and the related logo \u2014 are protected by Law No. 633 of 22 April 1941 on copyright, by the Industrial Property Code (Legislative Decree 30/2005) and by the applicable international conventions.

Reproduction, copying, publication, distribution, communication to the public, modification, elaboration and any other form of use of the contents, in whole or in part and by any means, is prohibited in the absence of written authorisation from the respective rights holders.

It is specified that the rights in the individual works may belong to the individual authors and members of the collective who made them and that, in the case of works produced with or for third parties, the exploitation rights may belong to the respective commissioners or rightholders. Publication of a work on this site is for the sole purpose of presenting the work carried out and does not imply any assignment or licence of rights in favour of users.

4. Permitted use of the site

The user may consult the site and its contents for personal, informational and non-commercial purposes. It is expressly prohibited to:

  • extract, copy or systematically reuse the contents, including by means of scraping, crawlers, scripts or other automated collection tools;
  • decompile, disassemble or subject the site or parts of it to reverse engineering;
  • introduce viruses, malicious code or carry out actions liable to damage, overload or compromise its functioning and security;
  • use the contents in a way that is harmful to the image, reputation or rights of the collective, its members or third parties.

5. Third-party contents and external links

The site embeds videos hosted on YouTube and contains links to external platforms, including Instagram. Those contents and platforms are managed by third parties, according to their own terms of use and privacy notices, which the user is invited to consult.

The collective exercises no control over external sites and assumes no responsibility in respect of their contents, their availability, the practices adopted in relation to personal data or any damage arising from their use. The presence of a link does not imply approval of or adherence to the linked contents.

6. Limitation of liability

While endeavouring to ensure the accuracy and updating of the information published, the collective gives no warranty as to continuity, uninterrupted availability, the absence of errors or interruptions of the service, nor as to the suitability of the contents for specific purposes.

To the extent permitted by applicable law, any liability for indirect, incidental or consequential damage arising from access to the site, from the inability to access it or from the use of the information contained in it is excluded. Nothing in these Terms limits liability for wilful misconduct or gross negligence, nor the rights inalienably recognised to consumers by the legislation in force.

7. Contacts through the site

The email addresses and telephone numbers published are made available for informational and contact purposes. Messages received and replies given are interlocutory in nature and do not in themselves constitute a contractual proposal or a binding acceptance for either party.

Any collaboration relationship is perfected exclusively by a separate and specific agreement, concluded in writing between the interested party and the individual members of the collective involved. The arrangements for processing data communicated by email or telephone are described in the Privacy Notice.

8. Changes to the Terms

These Terms may be amended at any time, for organisational needs or for regulatory adjustments. The version in force is the one published on this page, which shows at the top the date of the last update; amendments take effect from the moment of publication. Continued use of the site after publication constitutes acceptance of the updated version.

9. Governing law and competent court

These Terms are governed by Italian law. For disputes that may arise in relation to the site and these Terms, the statutory provisions on territorial jurisdiction apply.

Where the user qualifies as a consumer pursuant to Art. 3 of Legislative Decree 206/2005 (Consumer Code), the court of the place of residence or of the elected domicile of the consumer is inalienably competent, pursuant to Art. 66-bis of the same decree. The right to use the alternative dispute-resolution tools provided for by the legislation in force is unaffected.
